TERMS AND CONDITIONS
To ensure clarity and mutual understanding, the following Terms and Conditions apply to all our quotations, services, and projects. By engaging our services, you agree to the terms outlined below.
1. Scope of Work and Additional Costs: The scope of work shall include all labour, materials, and equipment necessary to complete the electrical installation, repair, or maintenance as specified in the provided quote. Any additional costs for unforeseen work, not included in the original quotation, will be communicated to the client, and require written approval before proceeding. An updated quotation will be provided to reflect these changes.
2. Validity: This quotation is valid for 14 days from the date of issue. After this period, Trinity Electrical Contractors (Pty) Ltd reserves the right to adjust pricing, as necessary.
3. SANS Compliance: All electrical work will be performed in compliance with the South African National Standards (SANS 10142-1: The Wiring of Premises) and any other relevant regulations. Any pre-existing non-compliance issues, identified during work, must be rectified to meet SANS requirements, potentially resulting in additional costs.
4. Safety Standards: All installations, repairs, and inspections will adhere strictly to safety standards as outlined by SANS regulations. This includes proper labelling, securing of electrical components, installation of tamper seals, and ensuring that supply cables and meters meet all required specifications.
5. Access: The client shall provide Trinity Electrical Contractors (Pty) Ltd with safe access to the premises to carry out the work. If access is denied or delayed, additional charges may apply. The client must also ensure that all areas are clear and safe for our technicians to operate in accordance with SANS safety guidelines.
6. Inspection and Sign-off: Upon completion of work, a detailed inspection will be conducted to ensure compliance with SANS 10142-1 and SANS 1524-1 standard. The inspection report must be signed off before the final handover. If non-compliance is detected, rectification work will be required, which may result in additional costs.
7. Calibration Certificates and Compliance for Installations: For all electrical installations- including, but not limited to, meter installations, Distribution Boards, and other electrical equipment- Trinity Electrical Contractors (Pty) Ltd requires that valid and up-to-date calibration certificates be provided and verified before the final sign-off and commissioning of the installation. All certificates must adhere to relevant industry standards and regulatory requirements, ensuring equipment meets accuracy and safety guidelines. Trinity Electrical Contractors (Pty) Ltd will not approve, energise, or hand over any installation until full compliance has been confirmed.
8. Workmanship and Warranties: All work performed is warranted to comply with SANS standards. In addition, we provide a 6-month warranty on our workmanship from the date of completion. Any defects or non-compliance or non-compliance issues arising from our work will be rectified at no extra cost within the warranty period. The warranty does not cover damages or issues resulting from unauthorised modifications or external factors beyond our control.
9. Payment Terms: A non-refundable deposit of up to 50% may be required upon acceptance of the quote to secure materials and booking of services. This deposit covers initial expenses and will be deducted from the total project cost. Payments are due within 30 days of invoice issuance. Late payments may cause legal actions and the forfeit of any applied discounts. Any additional costs, for unforeseen work not included in the original quotation, will be communicated, and agreed upon writing before proceeding.
10. Materials and Equipment: All materials and equipment supplied shall remain the exclusive property of Trinity Electrical Contractors (Pty) Ltd until full payment has been received. Clients acknowledge and agree not to use, modify, install, or resell any materials or equipment until full payment has been made. Any material shortages arising from site conditions, design alterations, or client requests will incur additional charges, which will be invoiced separately. If payment is not received within the agreed payment terms, Trinity Electrical Contractors (Pty) Ltd reserves the right to enter the client’s premises to recover any supplied materials, equipment, and/or installations without prior notice. The client agrees to grant Trinity Electrical Contractors (Pty) Ltd access to the premises for the retrieval of these items. Any costs associated with the recovery of materials and equipment, including labour and transportation, will be borne by the client.
11. Limitation of Liability: Trinity Electrical Contractors (Pty) Ltd shall not be held liable for any damage or loss resulting from non-compliance issues present before the commencement of our work or caused by factors outside our control, including unauthorised alterations, natural disasters, and/or client-provided equipment failure.
12. Non-Compliance and Rectification: Should any part of the installation fail to meet SANS regulations; the client will be responsible for the cost of necessary rectifications to ensure compliance. Trinity Electrical Contractors (Pty) Ltd will provide a detailed report of non-compliance issues and a quotation for the required remedial work.
13. Termination: Either party may terminate the contract with 14 days written notice. In the event of termination, the client shall be responsible for payment of all work completed up to the termination date, including any materials ordered and/or used.
14. Dispute Resolution: In the event of a dispute, both parties agree to first seek resolution through negotiation or mediation. Should these efforts fail, disputes will be resolved in accordance with South African law, and the client agrees to the jurisdiction of South African courts.
15. Permits and Approvals: The client is solely responsible for obtaining all necessary permits, approvals, or licenses required by local authorities, regulatory bodies, or other relevant institutions before the commencement of any work. This includes, but is not limited to, electrical work permits, signed approvals, safety inspections, and compliance certificates. If Trinity Electrical Contractors (Pty) Ltd is to obtain such permits on the client’s behalf, this must be explicitly agreed upon in writing prior to the start of the project. In such cases, any fees, costs, or delays associated with acquiring these permits will be the client’s responsibility and will be invoiced accordingly. Failure to secure the required permits or approvals may result in work delays, additional charges, or legal penalties. Trinity Electrical Contractors (Pty) Ltd will not be liable for any delays or complications arising from the client’s failure to obtain necessary permits and approvals. Additionally, should any work need to be removed, modified, or re-done due to non-compliance with permit requirements, the client will bear all associated costs.
16. Inspection and Sign-Off: A final inspection will be conducted upon completion of the work to ensure compliance with SANS standards. The client or an authorised representative must be present for this inspection and provide sign-off on the work. In the absence of sign-off, the work will be deemed accepted 7 days post-completion unless a written notice of defects is provided.
17. Insurance: Trinity Electrical Contractors (Pty) Ltd holds liability insurance for accidents and damage caused by our personnel during the project. The client is responsible for insuring their property and possessions during the work. We are not liable for pre-existing damages or conditions at the work site.
18. Tampering and Modifications: Any tampering, modifications, or repairs made by unauthorised parties will void the warranty. Trinity Electrical Contractors (Pty) Ltd will not be liable for any issues arising from such actions.
19. Cancellation: The client may cancel the work by providing a minimum of 3 days’ written notice to Trinity Electrical Contractors (Pty) Ltd. Cancellation requests must be submitted via email or written letter to ensure proper documentation. If the cancellation occurs before any materials have been ordered or work has commenced, the client will be entitled to a full refund of any deposit paid, minus an administrative fee for processing the cancellation. If the cancellation occurs, after materials have been ordered or work has commenced, Trinity Electrical Contractors (Pty) Ltd reserves the right to charge a cancellation fee of 10% of the total quoted amount. This fee is intended to cover any costs incurred for materials, labour, planning, and scheduling. Additionally, any custom or specially ordered materials that cannot be returned will be charged to the client at cost. A detailed breakdown of these costs will be provided upon request. Trinity Electrical Contractors (Pty) Ltd will not be responsible for delays in processing cancellations or refunds if the client fails to provide proper written notice.
20. Force Majeure: Trinity Electrical Contractors (Pty) Ltd will not be held liable for delays or failure to perform the work due to circumstances beyond our control, including but not limited to natural disasters, strikes, and/or government restrictions.
21. Confidentiality: Any proprietary information, including plans, designs, or materials discussed or provided during the work, shall be kept confidential by both parties, and not disclosed to third parties without written consent.
By accepting our documents, the client agrees to the above Terms and Conditions. Compliance with SANS regulations are mandatory, and Trinity Electrical Contractors (Pty) Ltd reserves the right to refuse sign-off on any installation that does not meet these standards.
